U.S. 50-State VAT/Sales Tax Deduction Practical Guide What Can Be Deducted, How to Deduct, and Where Pitfalls Commonly Arise
The United States does not have a Value-Added Tax (VAT) system; therefore, the concept of “state-level VAT input tax credit rules” does not exist. This is a common misconception in international tax practice while many countries adopt a VAT regime, the U.S. operates a consumption-based taxation system centered on Sales Tax, which is legislated, levied, and administered autonomously by individual states and local jurisdictions. The federal government neither imposes VAT nor establishes a uniform input tax credit mechanism.
Fundamental Differences Between Sales Tax and VAT

VAT is levied on the value added at each stage of production or distribution, and taxpayers are generally permitted to claim input tax credits for VAT paid on purchased goods or services. In contrast, U.S. Sales Tax is imposed solely at the final retail stage-charged to the end consumer and collected and remitted by the seller. Moreover, the vast majority of states do not refund or allow businesses to offset the Sales Tax already paid on their procurement expenditures. That is, business purchases typically cannot be “tax-deductible,” unless they meet specific statutory exemption criteria.
State-Level Tax Treatment Logic for Purchases
Not all purchases are subject to Sales Tax. Whether a purchase qualifies for exemption depends on its intended use, the nature of the item purchased, and the buyer’s eligibility-not on an “input tax credit” mechanism
1. Goods purchased by a business for resale (“Resale Items”) require the buyer to provide the supplier with a valid Resale Certificate. Such certificates are issued or recognized by the respective state tax authorities.
2. Raw materials or equipment directly used in manufacturing taxable products may qualify for a manufacturing exemption in certain states (e.g., Michigan and Ohio).
3. Emerging procurement categories-including software, digital services, and cloud computing-are treated very differently across states. For example, Texas considers Software-as-a-Service (SaaS) a non-taxable service, whereas New York taxes it based on the degree of customization.
4. Routine business purchases-such as office supplies, vehicles, and IT hardware-are generally subject to Sales Tax in most cases, with no subsequent refund or credit mechanism available.
Key Compliance Actions in Practice
Businesses operating in the U.S. must proactively complete three foundational compliance tasks
1. Determine whether they have established “Economic Nexus” in a given state-for instance, exceeding $100,000 in annual sales or 200 separate transactions in that state-which triggers the requirement to register and file Sales Tax returns.
2. Accurately provide suppliers with the appropriate state-specific Resale Certificate number and ensure the certificate remains valid (some states require annual renewal).
3. Maintain procurement-type classifications (e.g., “For Resale,” “Manufacturing Use,” “Internal Use”) by state within ERP or tax systems to avoid overpayment or underpayment risks arising from misclassification.
Special Attention Required
High-regulation jurisdictions-including California, New York, and Washington-have recently intensified audits verifying the authenticity of Resale Certificates. If a business improperly claims resale exemption for items actually used internally, tax authorities may impose retroactive assessments, plus interest and penalties. Additionally, while e-commerce platforms serving remote sellers (e.g., Amazon, Shopify) offer automated Sales Tax calculation tools, these tools cannot substitute for the business’s own professional judgment regarding the tax treatment of procurement activities.
The above outlines the core facts and operational essentials governing procurement-related tax treatment under the U.S. Sales Tax system-and we hope this information proves helpful to you.

December 12, 2024The experience was very good. I was still struggling to compare it with other companies. I went to the site a few days ago and wanted to implement it as soon as possible. I didn't expect that everything exceeded my expectations. The company is very large, with several hundred square meters. The employees are also dedicated and responsible. There is also a wall of certificates. I placed an order on the spot. It turned out that I did not make a wrong choice. The company's service attitude is very good and professional. The person who contacted me explained various things in detail in advance. After placing the order, the follow-up was also very timely, and they took the initiative to report the progress to me. In short, I am very satisfied and recommend this company!
