5. Preliminary Publication Upon passing substantive examination, the mark enters a three-month public opposition period, during which any prior right holder may file an opposition.

6. Registration Approval If no opposition is filed-or if an opposition is filed but dismissed-the electronic trademark registration certificate is issued. The registration is valid for 10 years, commencing from the approval date.

Violations are penalized under Article 57 of the PRC Advertising Law.

If a trademark is registered in the U.S. but not yet filed in China-and subsequently registered in China by a third party-the U.S. company must file an opposition during the preliminary publication period. Alternatively, within five years after the third party’s registration is granted, the U.S. company may file a request for invalidation under Article 45 of the PRC Trademark Law. Beyond this five-year window, legal remedies become extremely limited.

1. Simultaneously apply for copyright registration with the China Copyright Protection Center-particularly for original logo designs-and retain creation drafts and timestamped evidence.

3. Within 30 days after trademark registration is granted, complete voluntary trademark usage recordal with the Shenzhen Municipal Market Supervision Administration-not mandatory, but highly advisable to strengthen evidentiary integrity in future enforcement actions.
