The second step is to submit the application materials for trademark transfer. The applicant needs to submit the following documents to the Trademark Office of the National Intellectual Property Administration first, the trademark transfer application form; second, a copy of the trademark registration certificate; third, the original of the trademark transfer agreement; fourth, identity proof documents of the transferor; fifth, identity proof documents of the transferee. If the trademark is in a pledged state, then a written consent from the pledgee for the transfer is also required.
The third step is to pay the trademark transfer fee. According to relevant regulations, a certain handling fee is required for trademark transfer. The specific amount is uniformly stipulated by the National Intellectual Property Administration, generally ranging from several hundred to over a thousand yuan. Applicants should pay the fees in full and on time according to the requirements to avoid affecting the subsequent review progress.
The fourth step is to wait for the Trademark Office to review. After receiving complete application materials, the Trademark Office will conduct a formal review and substantive review. The formal review mainly checks whether the application materials are complete and standardized; the substantive review evaluates the possibility of the trademark violating prohibitive provisions. The entire review process takes approximately 3 to 6 months.
The fifth step is to announce the approval result. Trademark transfer applications that meet the conditions will be publicly announced in the Trademark Gazette. Within three months from the date of announcement, any person can raise objections. If there are no objections or if the objections are upheld, the Trademark Office will officially approve the transfer and issue a new trademark registration certificate.
The sixth step is to collect the new certificate and complete the handover. The transferee should collect the new trademark registration certificate within the specified period and handle relevant handover procedures with the transferor to ensure the smooth transition of trademark usage rights.
